Items listed on the Consent Agenda may be enacted by one motion and one vote. If discussion is required by members of the governing body, the item will be removed from the Consent Agenda and will be considered separately.

A. Approval of minutes for the March 26, 2019 Special Meeting/Executive Session, the March 26, 2019 Study Session and the March 26, 2019 Voting Meeting.

B. Award of City Contract No. 2019-193 to AZ Western Contracting Inc. for the FY19 Sidewalk Repairs Project, in the amount of $262,863.00. Funding is available in the FY19 Streets Fund.

C. Prescott Animal Park Association (Heritage Park Zoo) Contract Renewal.

D. Approval of City Contract No. 2019-210, with IK Consulting, in the amount of $30,000 for professional support services for continued Accela software implementation and training. Funding is available in the General Fund, Water Fund, Wastewater Fund and Streets Fund.

E. Prescott Heights Revision of plat to extend boundaries to incorporate an un-subdivided parcel containing an area detention basin.

F. Adopt Resolution No. 2019-1684 approving an Intergovernmental Agreement with Yavapai County for consolidated court operations. Funding is available in the General Fund.

ADOPT RESOLUTION NO. 2019-1684 OF THE MAYOR AND COUNCIL OF THE CITY OF PRESCOTT, YAVAPAI COUNTY, ARIZONA, TO APPROVE AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF PRESCOTT AND YAVAPAI COUNTY FOR CONSOLIDATED COURT OPERATIONS.

G. Approval of Amendment to City Contract No. 2019-164A1 with Earth Resources Corporation for the Crushing of Concrete-Inert Waste Mix and Asphalt Millings in an amount of $110,000.00. Funding for the project is available in the FY19 Solid Waste and Streets Funds.

H. Approval to amend City Contract No. 2018-225 to increase the annual amount for Bennett Oil offsite fuel contract for the remainder of FY19. Funding is available within the operating budget of each department that utilizes fuel.

I. Adoption of Resolution No. 2019-1683, amending the Intergovernmental Agreement (Contract No. 2013-195A5) with the City of Phoenix for the processing of recyclable materials.

ADOPT RESOLUTION NO. 2019-1683 OF THE MAYOR AND COUNCIL OF THE CITY OF PRESCOTT, YAVAPAI COUNTY, ARIZONA, TO APPROVE AN AMENDMENT TO AN EXISTING INTERGOVERNMENTAL  AGREEMENT BETWEEN THE CITY OF PRESCOTT AND THE CITY OF PHOENIX FOR THE PROCESSING AND DISPOSITION OF RESIDENTIAL RECYCLABLES.

Recommended Action: MOVE to approve Agenda Items 7.A. through 7. I.

8. CONSENT ORDINANCES

A. Amendment to Procurement Code Regarding Lease with Options to Purchase

ADOPT ORDINANCE NO. 2019-1658 OF THE MAYOR AND COUNCIL OF THE CITY OF PRESCOTT, YAVAPAI COUNTY, ARIZONA, AMENDING PRESCOTT CITY CODE TITLE I (ADMINISTRATIVE), CHAPTER 1-27 (PROCUREMENT CODE) BY INSERTING A NEW SECTION 1-27-24 (LEASE OF REAL PROPERTY WITH OPTION TO PURCHASE) AND RENUMBERING THE REMAINING SECTIONS ACCORDINGLY.

Recommended Action: Move to adopt Ordinance No. 2019-1658.

9. LIQUOR LICENSE AGENDA

A. ACQUISITION OF CONTROL

1. Public Hearing and consideration for an Acquisition of Control liquor license application for a Series 12 Restaurant liquor license from Dennis Richard McCormick, applicant, for Palace Restaurant & Saloon; Location: 120 S. Montezuma Street.

Recommended Action: 1) MOVE to close the Public Hearing

2) MOVE to approve/ deny/make no recommendation for Liquor License Application No. 51530 for an Acquisition of Control for a Series 12 Restaurant liquor license, for Palace Restaurant & Sa-loon; Location: 120 S. Montezuma Street.

10. REGULAR AGENDA

A. Award of City Contract No. 2019-207 to Kinney Construction LLC. for the Gurley Street and McCormick Street Water Main Replacement Project, in the amount of $882,409.70. Funding is available in the FY19 Water Fund Budget.

Recommended Action: MOVE to approve City Contract No. 2019-207.

B. Public Hearing on Development Impact Fees.

Recommended Action: MOVE to close the Public Hearing.

C. Site Plan and Water Service Agreement for proposed Peaks View Apartment project.

Recommended Action: Move to approve Site Plan PLN18-037 and Agreement for Potable Water, City Contract No. 2019-179 (WSA 18-022).

D. Accept Low Bid of $67,699.06 from Jebco Construction to construct an ADA accessible bathroom at the Prescott Boys and Girls Club. Re-allocate $37,645.81 in unspent CDBG funds to current Boys and Girls Club Requisition #1180413.

Recommended Action: 1) Accept Low Bid of $67,699.06 from Jebco Construction to construct an ADA accessible bathroom at the Prescott Boys and Girls Club.

Upon a public majority vote of a quorum of the City Council, the Council may hold an executive session, which will not be open to the public, regarding any item listed on the agenda but only for the following purposes:

(2) Discussion or consideration of records exempt by law (A.R.S. §38-431.03(A)(2));

(3) Discussion or consultation for legal advice with the city’s attorneys (A.R.S. §38-431.03(A)(3));
